Service note and employment contract – important changes 2024

With the EU Transparency Directive now integrated into Austrian labor law, specifically the AVRAG, adjustments have been made concerning the issuance of service notes (and subsequently employment contracts). These changes came into effect on 28th of March 2024 for new hires or newly issued service notes and employment contracts for salaried employees and freelance workers.

Here are the key changes summarized

  • From now on, employees have the choice to decide whether they want the service note handed out or transmitted electronically.
  • The existing minimum requirements must be supplemented as follows:
    • Applicable termination procedure
    • Company headquarters
    • Brief job description (in addition to stating the job role)
    • Information regarding the compensation for overtime
    • If applicable: information on the conditions for modifying shift schedules
    • Form of payout (in addition to indicating the due date)
    • Name and address of the health insurance fund (in addition to specifying the employee pension fund)
    • Duration and conditions of an agreed probationary period
    • If applicable: indication of entitlement to employer-provided training

There is still no obligation to issue a service note if a written employment contract is provided, which includes all necessary minimum details. Please be aware that the service note must be issued from the first day of employment! Violations may result in administrative penalties.

These changes apply to domestic employment relationships. Additional information in the service note is required for employees abroad.
